A purchaser of an off-plan apartment in Dubai Hills ignored DLD's 30-day notice to pay. DLD's official document puts the unit at 74% complete. What may the developer do without going to court?
Article 11(a)(4)(b) of Law No. 13 of 2008, as replaced by Law No. 19 of 2017, covers a unit between 60% and 80% complete: the developer may terminate unilaterally, keep up to 40% of the unit value stated in the agreement and refund the excess. At 74% the unit is in that band. Keeping the agreement alive and claiming the balance or an auction is available only where completion exceeds 80%; 25% of value is the below-60% tier, and 30% of payments is the not-commenced tier (and the original 2008 rule). Source: Law No. (13) of 2008, Art. 11(a)(4)(b), as replaced by Law No. (19) of 2017 (in force 12 Oct 2026).
Applying the above-80% remedies, or the 25% tier, to a unit between 60% and 80% complete.
