RERA Contracts A, B and F Explained
RERA requires brokers to use its smart contracts for marketing and sales (RERA Real Estate Brokerage Practice Guide, 2nd ed., Nov 2024). Three come up again and again.
| Contract | Between | What it does |
|---|---|---|
| A | The seller and the brokerage | An agreement to market the property |
| B | The buyer and the brokerage | An agreement recording the buyer's wish to buy |
| F | The seller and the buyer | The agreement to sell the property |
How they fit together in a resale
- The listing brokerage signs Contract A with the seller before marketing; every advert then needs a Trakheesi permit.
- The buyer's brokerage signs Contract B with the buyer.
- When terms are agreed, seller and buyer sign Contract F; the sale is then completed and registered through a registration trustee office.
- If a Contract F dispute arises, the parties can apply through Trakheesi for RERA's amicable settlement service; if that fails they go to the courts.
What the brokers register says about commission
- A brokerage agreement must be in writing, naming the parties, the property and the terms (Bylaw No. 85 of 2006, Art. 26).
- Commission is set by agreement, otherwise by prevailing practice (Art. 27).
- It is earned only if the contract is concluded; by default on signing the sale contract and registering it with DLD (Art. 28).
- Several brokers acting for one party share one commission (Art. 31); if a party appoints several brokers separately, only the one who concludes the deal is paid (Art. 32).
