A brokerage's written agreement with a seller in Jumeirah Village Circle says nothing about when commission falls due. The parties sign the sale contract on 3 February 2027 and the sale is registered with the DLD on 24 February 2027. When is the brokerage entitled to its remuneration?
Article 28(2) of Bylaw No. 85 of 2006 entitles the broker to remuneration upon signing the sale contract and registering it with the DLD, unless the brokerage agreement says otherwise. This agreement is silent, so both steps are needed and the right arises on registration, 24 February 2027. Signing alone on 3 February is only half the default rule. Nothing in the Bylaw ties the fee to receipt of the full price. Source: Bylaw No. (85) of 2006, Art. 28(1)-(2) (in force 12 Oct 2026).
Stopping at signature and forgetting that the default rule also requires registration with the DLD.
