A Palm Jumeirah owner separately signs non-exclusive agreements with three brokerages to sell her villa. The agreements say nothing about expenses. Only Brokerage C introduces the buyer who completes. How is remuneration dealt with?
Article 32 of Bylaw No. 85 of 2006 provides that where one party engages several brokers severally on one matter and only one succeeds, that broker is exclusively entitled to the whole remuneration. The unsuccessful brokerages cannot recover expenses either, because Article 30 denies compensation and costs where their efforts did not lead to a contract, unless the agreement provides otherwise, and these agreements are silent. Equal division is the Article 31 rule for brokers acting together, not for brokers engaged separately. Source: Bylaw No. (85) of 2006, Arts. 30-32 (in force 12 Oct 2026).
Applying the Article 31 sharing rule to brokers who were engaged separately rather than together.
