Article 23 of Bylaw No. 85 of 2006 provides that a broker forfeits his right to remuneration and to claim refund of expenses if he breaches his obligations to his client by acting in the interest of the other party or by accepting a promise of a benefit from the other party, where this is inconsistent with good faith or the code of professional ethics. Hassan did both. Under Article 22 he is also liable for the seller's loss. Declaring the payment does not cure the breach. Source: Bylaw No. (85) of 2006, Arts. 22-23 (in force 12 Oct 2026).
