A tower's completion certificate was issued on Monday, 1 March 2027 and Noura took handover of her unit on Sunday, 20 June 2027. On Wednesday, 10 May 2028 its plumbing installations fail. Is the developer still liable to repair them?
Article 40(b) of Law No. 6 of 2019 (in force 12 Oct 2026) makes the developer liable for one year from the date of handover of the unit to repair or replace defective installations such as mechanical, electrical, sanitary and sewerage works. Handover on 20 June 2027 gives cover until 20 June 2028, so a failure on 10 May 2028 is covered. Counting from the completion certificate was the rule under the repealed Law No. 27 of 2007 (Art. 26(2)); the ten-year period applies to structural defects only. Running the one-year installation warranty from the completion certificate, as the repealed 2007 law did.
